    As announced the insolvency administration together with the members of the creditors’ board have developed a system to lodge the claims in an easy and time-saving electronic way for the atypical silent shareholders.

     

    The database underlying the system (it’s an Excel sheet) is completed and is avalaible to the association for the protection of creditors (AKV EUROPA – Alpenländischer Kreditorenverband / Kreditschutzverband von 1870 / Creditreform – Österreichischer Verband Creditreform / Insolvenzschutzverband für ArbeitnehmerInnen), the Austrian Consumer Asscication (VKI) als well as to legal professionals authorized for representation, especially laywers. The above mentioned organizations or persons can use the newly developed system to make the lodgement of the claims on behalf of the creditors to the insolvency court.

     

    The Excel Sheet has to be filled out in the columns provided and the claim has to be lodged to the insolvency court. The file has to be transferred electronically to the liquidator. You have to transfer alweays the whole file, so a participation to this system makes only sense if there is a majority of creditors represented.

     

    Due to legal reasons an online lodging of the claims directly to the insolvency court or to the liquidator is not possible.

     

    It is expressly advised that claims lodged directly to the liquidator have no legal effect.

     

    Because of the large number of affected people the insolvency administration asks also for unterstanding that individual requests cannot be answered. If creditors need help with their claims, it is recommended, that they ask the assocation for the protection of creditors or a laywer for support.

    Comme cela avait été annoncé, l’administration judiciaire a mis au point, en collaboration avec les membres du comité des créanciers, un système permettant de déclarer, par voie électronique d’une façon rapide et économique, les créances des associés tacites atypiques.

     

    La banque de données (il s’agit d’un fichier excel) nécessaire à ce système vient d’être finalisée et est mise à disposition des organismes de protection des créanciers (par exemple, le Kreditschutzverband von 1870, Mozartstraße 11, 4015 Linz / insolvenz.linz@ksv.at ), de l’association pour l’information des consommateurs VKI et de toutes les personnes autorisées à représenter les parties de façon professionnelle, en particulier les avocats, qui peuvent produire la demande des créanciers les ayant mandatés auprès du tribunal de Linz par le biais de ce système. Pour la production d’une créance par le biais de ce système, le tableau excel doit être rempli pour les créanciers concernés dans les colonnes prévues à cet effet et cette créance doit être déclarée auprès du tribunal de Linz. Le fichier doit être transmis à l’administrateur judiciaire par voie électronique. Etant donné que c’est toujours le fichier complet qui doit être transmis ou remis, une participation à ce système n’est judicieuse que lorsqu’un grand nombre de créanciers sont représentés.

     

    Pour des raisons juridiques, il n’est pas possible de produire sa créance en ligne auprès du tribunal compétent ou de l’administrateur judiciaire.

     

    Nous souhaitons expressément attirer votre attention sur le fait que les demandes adressées à l’administrateur judiciaire n’ont aucun effet juridique.

     

    En raison du nombre élevé de créanciers concernés par la procédure d’insolvabilité, l’administration judiciaire vous prie de noter qu’elle ne pourra pas répondre individuellement aux demandes des créanciers. Il est recommandé aux créanciers ayant besoin d’aide pour produire leur créance de s’adresser à un avocat ou à l’organisme de protection des créanciers mentionné ci-dessus.

    Come già annunciato, l’amministrazione giudiziaria ha sviluppato, in collaborazione con i membri del comitato dei creditori, un sistema per dichiarare, per via elettronica in maniera rapida ed economica, i crediti dei soci taciti atipici.

     

    La banca dati (si tratta di un file excel) necessarie per tale sistema è stata appena finalizzata e è messa a disposizione delle organizzazioni della protezione dei creditori (per esempio, il Kreditschutzverband von 1870, Mozartstraße 11, 4015 Linz / insolvenz.linz@ksv.at ), dell’associazione dei consumatori VKI e di tutte le persone autorizzate a rappresentare le parti in modo professionale, in particolare gli avvocati, che possono insinuare la domanda dei creditori, che li hanno incaricati, presso il tribunale di Linz attraverso questo sistema. Per l’insinuazione di un credito attraverso questo sistema, la tabella excel deve essere compilata per i rispettivi creditori nelle varie colonne e una domanda di credito deve essere trasmessa al tribunale di Linz. Il file deve essere mandato all’amministratore giudiziario via posta elettronica. Poiché è sempre il file completo che deve essere trasmesso o presentato, una partecipazione a questo sistema è solamente opportuna se un gran numero di creditori sono rappresentati.

     

    Per motivi giuridici, non è possibile insinuare il credito in linea presso il tribunale competente o l’amministratore giudiziario.

     

    Si ricorda espressamente che le domande indirizzate all’amministratore giudiziario non hanno alcun effetto giuridico.

     

    A causa del numero elevato di creditori interessati da questa procedura d’insolvenza, l’amministrazione giudiziaria La prega di notare che non sarà possibile rispondere individualmente alle richieste dei creditori. Si raccomanda ai creditori che hanno bisogno di assistenza per insinuare il loro credito di prendere contatto con un avvocato o l’organizzazione della protezione dei creditori summenzionata.

    Most likely there will be more than 15.000 creditors. The usual way of filing the claims would be a logistical problem.

     

    Therefore the insolvency administration and the members of the board of creditors (AKV EUROPA – Alpenländischer Kreditorenverband / Kreditschutzverband von 1870 / Creditreform – Österreichischer Verband Creditreform / Insolvenzschutzverband für ArbeitnehmerInnen / Verein für Konsumenteninformation) are working on a system for the filing of the claims in an easy and time-saving electronic way.

     

    Members of this system shall be the association for the protection of creditors, the “VKI” and legal professionals authorized for representation, especially laywers.

     

    The insolvency administration will publish more details, as soon as the work on the planned system is done. The insolvency administration asks for yout patience and understanding. Because of the large number of affected people the insolvency administration asks also for unterstanding that individual requests cannot be answered.

    At the moment the liquidators are examining the requirements for the continuation of the companies. A decision will be made during the next week.
